Is there a time limit for claims?
As yet no general cut-off date for joining the Group Action has been imposed by the Court. The normal rule for personal injury claims is that they must be brought within 3 years of the date when you are aware that you are suffering from an illness as a result of the negligence of which you are complaining. It is therefore important that you register your claim at the earliest opportunity.
There is, however, a deadline which has been imposed by the Court for any client who registered their claim with Bogue & McNulty solicitors prior to 1st April 2003. For these claimants there is a strict deadline of 27th February 2004 to sign the cost-sharing agreement and join the Group Action. If they do not join by this date their claims will be debarred - i.e. they will not be able to claim at any time in the future.
Following an application to the Court on 27th February this time limit has
been extended to 31st March.
