What is cost-sharing?

Cost-sharing is the means by which the cost of running a Group Action is divided between all of those who wish to make a claim. The principle is based on fairness in that everyone benefits from the generic work and therefore must contribute equally.

In this case the cost of the work at present is divided between approximately 3,100 Plaintiffs who are currently on the Register. Clients who instruct this firm are funded by the Police Federation. The Federation pays its members contributions to the generic costs on their behalf. There are a number of other Plaintiffs who instruct their own solicitor and those Plaintiffs pay their share of the costs on a quarterly basis. These claims are also co-ordinated by Edwards & Co., but each Plaintiff is represented individually by their own solicitor and ultimately, if the generic case is successful, their own solicitor will deal with their individual claim for damages.

Cost-sharing clients are responsible for:-

  1. their share of the generic costs which must be paid on a quarterly basis to Edwards & Co.
  2. their share of the overall costs of the Action if it is wholly or partly unsuccessful, including the Defendants' costs.
